Understanding the types, concepts and risk in a civil construction contract (including SOPA) is a key skill for your team.  Focusing on a civil construction environment, this course covers:

·         What is a ‘contract’?

·         Elements of a contract

·         Common types of civil construction contracts (C, D&C, Alliance, PPP)

·         Key concepts and risks – extensions of time, delay costs, latent conditions, liquidated damages, practical completion, defects liability, free issue materials and payment

·         Fundamentals of the SOP law across Australia, and other laws affecting payment

·         Obligations on head contractors and sub-contractors/suppliers

·         Importance of understanding the deliverables, the reporting and adherence to contract terms

·         The impact of variations on cash – and how they are applied in SOP

·         Mechanisms for change – claiming for variations, delay costs, latent conditions and other unexpected events under a contract

·         Closing out a contract – how does SOP law wrap up?

·         Breaches of contract – how they occur, and what can be done about them

·         Dispute process, termination, and contract completion

·         Compensable causes and delay costs

·         Insurances

 

Learning Outcomes:

This course will give participants considerable insight into the Security of Payments Act, and their obligations and responsibilities to ensure successful completion of a contact. While focused on the important legal principles, it will do this in a very practical way and apply them in a civil construction context. 

The session will also look at some recent court decisions including about a how payment claim can now include the recovery of the proceeds of a wrongfully upon bank guarantee payment or bond.
